Case Over Ohios $300 Weekly Unemployment Checks Sent Back To County Court

The fight to bring back the $300 weekly additional checks to unemployed Ohioans remains up in the air after an appeals court decided to send the case back to a county judge.

Advocates to revive the pandemic unemployment assistance say this gives reason to start sending the weekly checks again.

The 10th District Court of Appeals ruled that a lower courts decision to deny reinstating the additional unemployment assistance is based on an analysis that is incomplete.

The appeals court says the Franklin County Court of Common Pleas did not address two factors in the case unjustifiable harm to third parties or any public interest served by the injunction.

Zach Schiller with Policy Matters Ohio says theres still hope the additional $300 a week will be paid out retroactively.

I would certainly hope that there could be some benefits that could be paid out beyond those that expire on September 4, Schiller said.

But Attorney General Dave Yost is asking the Ohio Supreme Court to reverse the appeals courts decision.

The state argues that Gov. Mike DeWine had the legal right to stop accepting the federal funds for the program.

Ohio stopped accepting the federal dollars to pay out the checks at the end of June. Gov. Mike DeWine said vaccines and other protection measures were in place that allowed people to go back to work.

In ending those checks, DeWine said the coronavirus vaccine and other protective measures make it safe for people to return to work.

Cutting Off Benefits Hasnt Fixed Perceived Labor Shortages

States that cut off benefits early have backed up their decisions with anecdotes of worker shortages to push people back to work.

But early cutoff data doesnt validate those claims. Analysis from workforce management firm UKG reported states that ended benefits in June saw half the shift growtha measure of the number of worker shifts completedin July versus states where the unemployment boost has continued.

Another report from payroll company Gusto found that employment growth was similar for states that retained the benefits versus cut them off.

The slower-than-anticipated job growth, especially in states that have ended benefits early, indicates a disconnect between the jobs available and what workers are looking for. Census Bureau data from early August showed that only 9% of unemployed individuals were in that situation because they didnt want to work.

The unemployment rate, which is known to undercount the number of jobless people, is still at 5.4% as of July.

Some are arguing that the ongoing delays in Congress passing a new stimulus bill that includes UI benefits extensions may mean a lapse or extended delay in 2021 payments even if a bill is passed in the next week or two. Based on the challenging rollout of other Pandemic unemployment programs this year, worker advocates say it could take weeks for the antiquated state unemployment systems and programs to get updated and process claims/payments for new benefits.

With Democratic candidate Joe Biden winning the Presidential election and Senate Republicans likely to retain control of the Senate , the probability of a stimulus package containing supplementary unemployment benefits happening this year is very remote as Trump and the Democrats have no political incentive to compromise. This means current and retroactive payments under the CARES act enhanced unemployment programs will expire at the end of the year. Further, it is also highly likely that the next stimulus package will be much smaller and more focused. This means any supplementary unemployment benefits will be in the $300 to $400 range and for a short period . More details will come soon and I will post updates as that happens.

Pandemic Unemployment Assistance Program Extension

PUA assists workers who lost their jobs due to COVID-19 and are not typically eligible for other unemployment compensation programs. This includes gig workers, freelancers, and self-employed workers.

Important PUA program extension information for claimants follows.

  • You can begin filing for the additional 11 claim weeks today, January 22.
  • Follow the same process as before to log onto your dashboard and claim the additional weeks, which will be added to your account.
  • You must file by January 29. If you miss this deadline, you will need to email ucpua@pa.gov to request backdating.
  • You will be able to file for the weeks of January 2 9 16 and 23.
  • If you no longer had claim weeks or did not file for the week ending December 26, 2020, for any reason, you MUST REOPEN your claim before you can proceed. To do this, log onto your dashboard and click on the link to reopen a claim.
  • If you tried to open a new claim while the PUA program was inactive, you will have error codes that the UC staff must fix before you can proceed. Please be patient while we work quickly to resolve your issue.
  • If you are a new, first-time PUA claimant opening a claim in 2021, you cannot yet file. We are still adding 2020 as a base wage year in the system and will notify you when you are able to file for benefits.
  • You will automatically receive the extra $300 weekly Federal Pandemic Unemployment Compensation you do not need to take any action to get this boost.

Anyone who qualifies for unemployment benefits, either traditional or PUA payments, automatically qualifies and receives the extra $300 FPUC payments.

The weekly benefit is different from the $300/week Lost Wages Assistance program implemented late last summer, where filers had to take extra steps to receive the funds.

The Brownback administration opted in 2011 to bring in a new contractor, IT21, amid concerns from top KDOL officials that the project still wasnt on the right track.

It also didnt raise any concerns that the project was over budget, a common complaint cited by the Brownback administration. In fact, documents show it was ahead of expectations when it came to spending.

Reminder: Federal Unemployment Benefit Programs Are Set To End On Sept 4

Pennsylvania Department of Labor & Industry Secretary Jennifer Berrier issued a reminder Tuesday that federal unemployment benefit programs like Pandemic Emergency Unemployment Compensation, Pandemic Unemployment Assistance, and Federal Pandemic Unemployment Compensation will end Sept. 4.

The federal unemployment benefit programs that helped many workers during the most difficult days of the pandemic will soon end, Berrier said in a press release. We encourage those receiving these temporary benefits to prepare for this change. L& I is working with its partner agencies and organizations to help identify programs and support services to help Pennsylvanians with this transition.

Pennsylvania’s unemployment compensation program and those receiving benefits from it are unaffected, Berrier added.

The federal pandemic-related unemployment programs set to end on Sept. 4 include:

Pandemic Emergency Unemployment Compensation

PEUC provided additional weeks to individuals enrolled in the Unemployment Compensation program. When PEUC ends Sept. 4, UC will revert to providing up to 26 weeks of unemployment benefits to eligible individuals. Those who have exhausted their 26 weeks of UC benefits will cease to receive benefit payments for weeks of unemployment after Sept. 4 under that claim.

Who Is Eligible For Extended Unemployment Benefits

What benefits are unemployed workers eligible for? Ordinarily, workers in most states are eligible for 26 weeks of unemployment benefits, although some states provide less coverage. Montana is the only state that provides more with 28 weeks of unemployment benefits.

In times of high unemployment, the federal government provides funds to the states to extend unemployment insurance programs for additional weeks of benefits beyond what each state offers.

Check with your state unemployment office for information on the availability of extended benefits in your location. You can find a directory of offices on the Department of Labors CareerOneStop Unemployment Benefits Finder.

How Do I Apply For Pua

If you were already filing biweekly for PUA before the program ended, you can begin filing using that same dashboard anytime between Friday, Jan. 22 to Jan. 29. Missing the Jan. 29 deadline means youll have to email to request backdating.

PUA-eligible people who didnt file for the week ending Dec. 26 have to reopen a claim to receive benefits. Select File for Weekly Benefits in your dashboard, and File Your Weekly Certification to Continue Your Claim. Follow the prompt to reactivate your claim from there.

One note from L& I: If you tried to file for PUA after it expired and got an error message, department staff have to resolve your account. Please be patient, the department said in a release.

The Pennsylvania Department of Labor and Industry is set to resume making payments through the Pandemic Unemployment Assistance and Pandemic Emergency Unemployment Compensation programs but could see a gap in benefits after a delay in approval by the federal government.

The department announced on Monday that more than 509,000 workers in the commonwealth could see gaps in their payments through unemployment assistance as it awaits approval from the federal Department of Labor.

Both the PUA and PEUC, as well as the Federal Pandemic Unemployment Compensation program all received extensions this month through the COVID relief package after President Donald Trump signed the $2.3 trillion bill into law Sunday night.

The CARES Act extensions will ensure Pennsylvania workers who have been affected by the global economic downturn caused by COVID-19 will continue to receive the unemployment support they desperately need for themselves and their families, said Jennifer Berrier, secretary for the Department of Labor and Industry. L& I began reviewing the legislation last week when it was first unveiled and will resume making payments for the PUA and PEUC programs as soon as we get approval from the federal Department of Labor to move forward.

Payments under all three programs cant resume until the state Department of Labor and Industry receives guidance and approval from DOL, which the department said could take several weeks.

Where To Go For Help

Claimants affected by the end of the PUA benefits should visit the state Department of Human Services website at dhs.pa.gov for information on health, medical, and childcare benefit programs, Berrier said.

The states PUA hotline will remain open for two weeks after Sept. 4. Once it closes, PUA claimants should call the regular unemployment compensation number for help.

The agency said in a statement that Pennsylvanians can file for a final week of benefits through the PUA during the week ending Sept. 11.

Also, the department said unemployment compensation will be limited to 26 weeks once the federal extension ends. The maximum available is $580 a week.

Those needing help finding work can go to pacareerlink.pa.gov to find a county PA CareerLink office and other information on services, such as job openings and resume writing.

We want individuals affected by the end of the federal programs to be as prepared as possible, Berrier said.

Inez Titus, the Department of Human Services deputy secretary for the Office of Income Maintenance, also appeared with Berrier and said that anyone losing federal benefits should know that help is available through her department.

Resources available from Human Services include information on Medicaid, Childrens Health Insurance Program , Supplemental Nutrition Assistance Program , Temporary Assistance for Needy Families and Child Care Works.

Applications for assistance can be submitted at compass.state.pa.us.

What Is Federal Pandemic Unemployment Compensation

The Federal Pandemic Unemployment Compensation program, authorized by the CARES Act and renewed by subsequent legislation and a presidential order, initially provided $600 per week in extra unemployment benefits to unemployed workers in states that opted into the program.

In August 2020, the additional payment was lowered to $300, the amount continued by the American Rescue Plan Act of 2021 through Sept. 6, 2021.

What Are The Requirements For Unemployment Tier 4

Tier 4 added 6 weeks of benefits, although in 2012 this was increased to 16 weeks after a reduction in Tier 3. This tier required a total unemployment rate of at least 8.5 percent in the state of residence, or an insured unemployment rate of at least 6 percent. In 2012, the benefit distribution between Tiers 3 and 4 was altered.
